General Terms and Conditions


Safety:
Safety is our priority. We endeavor to create a safe working environment for us and our customers.
Please let us know as soon as possible if you are aware of any hazards that may not be immediately
apparent. This includes informing of us if anyone on the property may be infectious with COVID-19 or
any other infectious disease.
Customers and bystanders must remain a reasonable distance away from any work being completed,
and follow the instructions given by our team to move out of range, for the safety of all involved.

Property:
By accepting this quote you acknowledge that you have obtained any necessary resource consents and
checked the certificate of title of the property where works will be taking place and that nothing on the
property title should prevent Hilltop Tree Services from legally completing the work requested.
If you are not the owner of the assets mentioned in this quote, by accepting the quote you take full
responsibility that the works are permitted, and you have the owners consent if required.

Whilst we will take every precaution we can to protect your driveway and other access points, any
damage caused by our machinery due to poorly constructed driveways will not be our responsibility.

Stump grinding:
Unless a plan showing the exact location & depth of underground pipes, wires, or cables has been
forwarded to Hilltop Tree Services by the customer or their agent prior to the commencement of the
works, Hilltop Tree Services shall be under no liability for any damage caused to such pipes, wires or
cables as a result of work performed, or any damage to property resulting there from. The customer
shall be solely liable for any such damage.


Quotations for stump grinding are based on the assumption that the stumps are free from metal, rocks
or other hidden obstructions. In the event of a stump being highly contaminated due to hidden
obstructions, Hilltop Tree Services reserves the right to increase the charge in accordance with additional
costs incurred.


If the grinding is specified at a 'surface grind', then stumps will be ground approx 100mm below the
surface of the ground, enough for grass to grow over if required.
A full grind will mean the whole stump is ground out, and roots will be chased to approx 100mm
diameter.

Payment terms:
Payment will be expected upon invoice, the due date being the date of invoice, unless otherwise
specified. Please let us know in advance if you think you may require a payment plan or have any issues
with payment.


Interest may be charged on any amount owing after the due date at the rate of 1.5% per month. Any
expenses, disbursements and legal costs incurred by Hilltop Tree Services in the enforcement of any
rights contained in this contract shall be paid by the customer, including any reasonable solicitors fees or
debt collection agency fees

Cancellations:
Cancellation Fee:
Whilst we will in all cases where possible try to rebook any work at a time suited to the customer, we
reserve the right to charge a cancellation fee of up to 20% to cover lost time and costs associated with
the contract if less than 24 hours’ notice of cancellation is given. You must pay that fee in accordance
with the payment terms above.


If the customer cancels the work request but a traffic management plan had already been ordered, there
will be a charge of $350+GST to cancel this.

Delays:
We do our best to complete all work on the days booked. However, from time to time we may need to
make changes to our scheduled jobs, or if we are unable to complete all work on the day booked, such
as in the case of emergency, weather issues or staffing shortages. Dates provided for commencement
and/or completion of any Services are provided in good faith as an indication for planning purposes only.
We have the right to amend any such dates in its absolute sole discretion and shall have no liability
arising from any delay in commencing or completing any Services.

Issues or disputes:
We pride ourselves on providing great quality work that our customers are happy with. If you are
unhappy with work completed, please raise this with us as soon as possible so that we can work to

Please raise any concerns within seven (7) days of the work completion, to ensure timely response and
resolution.


You must raise any complaint or dispute about our services within seven (7) days of the performance of
the services. If you do not do so, you will be deemed to have fully accepted the services.
